SeeJay — Privacy Policy

1. Who We Are
SeeJay ("SeeJay," "we," "us," or "our") is point-of-sale and online ordering software for small and home-based businesses. SeeJay is operated by Christian Ortiz, a sole proprietor based in San Jose, California.

This policy explains what information we collect, why, and what you can do about it.
2. Two Kinds of People Use SeeJay
Our privacy practices differ depending on who you are:
Shop Owners — small business owners who use SeeJay to run their shop: create a menu, take orders, and get paid.
Customers — people who order from a shop that uses SeeJay. Customers do not create SeeJay accounts.
Where a section applies to only one group, we say so.
3. Information We Collect
3.1 From Shop Owners
When you create a SeeJay account and set up your shop, we collect:
- Account information: your email address and password (passwords are stored in hashed form by our authentication provider — we never see them)
- Business information: business name, business type, operating hours, pickup locations and addresses, and the menu items, prices, and photos you choose to upload
- Brand assets: your logo and selected brand color, if you provide them
- Order and sales data: the orders placed with your shop through SeeJay, including items, totals, payment method, and status
3.2 From Customers
When you place an order with a shop using SeeJay, we collect:
- The name you provide when placing the order
- Your order details: items, quantities, options, total, and whether you chose to pay by card or with cash at pickup
- Contact information you provide for order updates, where offered (see "Planned Features" below)
You do not need to create an account to order. We do not require you to give us more than what is needed to fulfill your order.
3.3 Payment Information — Important
SeeJay does not collect, process, or store your card number, CVC, or bank account details. Ever.
Card payments are handled entirely by Stripe, Inc., a PCI-compliant payment processor. When you pay by card, you are entering your details on Stripe's systems, not ours. We receive only a confirmation from Stripe that a payment succeeded, along with a transaction reference — never the card itself.
For Shop Owners who enable card payments: Stripe collects the identity and banking information required to pay you out (legal name, tax identification number, date of birth, and bank account details). That information goes directly to Stripe and is never stored on SeeJay's servers. Stripe's handling of it is governed by Stripe's Privacy Policy.
We store only Stripe's account identifier for your shop and whether your account is enabled to accept charges and receive payouts.
3.4 Technical Information
We collect the minimal technical information necessary to operate the service securely — for example, authentication session data and standard server logs kept by our infrastructure providers.
We do not use analytics tools, advertising trackers, or third-party marketing pixels. We do not use cookies to track you across websites. We do not sell your data. We do not have a Google Analytics or Meta Pixel installed, and we have no plans to add one.
4. Planned Features (Not Yet Active)
We intend to add the following features. When we do, they will work as described here.
Digital loyalty programs. Shop Owners may offer loyalty rewards. With your consent, a Customer may provide an email address or phone number so a shop can track their loyalty progress. This information will be used only to operate that shop's loyalty program and will not be sold, rented, or used for advertising.
Email and SMS receipts and order updates. With your consent, a Customer may provide an email address or phone number to receive an order confirmation, a receipt, a pickup notification, or a thank-you message. This information will be used only for those messages. Standard message and data rates may apply for SMS. You will be able to opt out at any time, including by replying STOP to any SMS message.
We will not use these contact details for marketing without separate, explicit consent. Providing a phone number or email will never be required in order to place an order.
5. How We Use Information
We use the information described above to:
- Operate SeeJay: create and display shop pages, take orders, and show shop owners their orders and daily totals
- Process payments through Stripe and confirm that they succeeded
- Communicate with Shop Owners about their account, service issues, or changes to SeeJay
- Provide support when you contact us
- Keep the service secure, prevent fraud and abuse, and fix problems
- Comply with our legal obligations
We do not sell personal information. We do not share it with advertisers. We do not use it to build profiles for marketing purposes.
6. Who We Share Information With
We share information only with the service providers necessary to run SeeJay, and only for that purpose:

Each is contractually obligated to protect the information they process on our behalf.
We may also disclose information if required by law, valid legal process, or to protect the rights, safety, or property of SeeJay, our users, or the public.
If SeeJay is ever sold or merges with another business, information may transfer as part of that transaction. We will notify you before your information becomes subject to a different privacy policy.
7. How Long We Keep Information
- Shop Owner accounts and shop data: for as long as your account is active. If you close your account, we will delete or anonymize your data within 90 days, except where we are legally required to keep records.
- Order records: retained as long as necessary for the shop's business records, dispute resolution, and tax purposes.
- Payment records: retained by Stripe under Stripe's own retention policies. We keep only transaction references.
8. Security
We take reasonable measures to protect your information, including:
- Encryption of data in transit (HTTPS)
- Access controls that ensure a shop owner can only access their own shop's data
- Passwords stored in hashed form; we never see them
- Card data never touching our servers
No system is perfectly secure. If we become aware of a data breach affecting your personal information, we will notify you as required by California law and any other applicable law.
9. Your Rights (California Residents — CCPA/CPRA)
If you are a California resident, you have the right to:
- Know what personal information we have collected about you, where it came from, why we collected it, and who we shared it with
- Access a copy of your personal information
- Delete your personal information, subject to legal exceptions
- Correct inaccurate personal information
- Opt out of sale or sharing of your personal information — we do not sell or share personal information, so there is nothing to opt out of
- Limit use of sensitive personal information — we do not collect sensitive personal information as defined by the CPRA
- Non-discrimination: we will never charge you a different price or provide a lower quality of service for exercising your privacy rights
To exercise any of these rights, email support@seejaypos.com. We will respond within 45 days. We may need to verify your identity before acting on a request — for a shop owner, by confirming control of the account email; for a customer, by matching the details of the order in question.
You may designate an authorized agent to make a request on your behalf.
10. Rights Outside California
If you are located outside California, other privacy laws may give you similar rights. We honor requests to access or delete personal information regardless of where you live. Email support@seejaypos.com.
11. Children's Privacy
SeeJay is not directed to children under 13, and we do not knowingly collect personal information from children under 13. If you believe a child has provided us with personal information, email support@seejaypos.com and we will delete it.
12. Shop Owners Are Responsible for Their Own Customers
If you are a Shop Owner, you are the business your customers are buying from. You are responsible for how you use the customer information SeeJay makes available to you (for example, order names and, in the future, loyalty contact details), and for complying with any privacy or marketing laws that apply to your business — including anti-spam and SMS consent laws.
SeeJay provides the tools. How you use them is up to you, and the responsibility is yours.
13. Changes to This Policy
We may update this policy. If we make material changes, we will update the "Last Updated" date and, for Shop Owners, notify you by email or in the app. Continued use of SeeJay after a change means you accept the updated policy.
